These Terms and Conditions outline the rules and regulations for the use of our photography services. By booking a session with us, you agree to these terms and conditions. Please read them carefully before confirming your booking.

1. Booking & Payment

1. Booking Confirmation:
   A booking is only confirmed once the deposit of £30 is paid, regardless of the session type. The remaining balance is due on the day of the session unless otherwise agreed upon.
2. Payment Methods:
   We accept payments via bank transfer and cash. All payments must be cleared before the session takes place unless other arrangements are made in advance.
3. Deposits:
   A deposit is required to secure your session date. Deposits are non-refundable but may be used for rescheduling within the specified terms.

2. Rescheduling & Cancellations

1. Rescheduling:
   You may reschedule your session up to two times, provided you give at least 48 hours’ notice before the scheduled session. If notice is given less than 48 hours before the session, the deposit will be forfeited.  After the second reschedule, the original deposit will be lost, and a new deposit will be required for any future bookings.
2. Cancellations:
   The deposit is non-refundable in the event of a cancellation.
3. No Shows:
   If you fail to attend the session without prior notice, the deposit will be lost.

3. Photography Usage & Copyright

1. Copyright Ownership:
   All photos taken during the session are the property of Joanna S. Photography. You will receive a license to use the images for personal purposes only. Commercial use of the images is not permitted without prior written consent.
2. Usage Rights:
   By booking a session with us, you agree that we may use the images on our website, social media, and promotional materials. If you prefer not to have your images used, please inform us prior to the session.
3. Image Delivery:
   The client will receive an online gallery with all the images from the session. The client can then select the images they would like to be edited. Once the selection is made, the chosen images will be edited and delivered through the agreed-upon method. The client will be notified when the images are available for viewing or download.
4. Watermarking Unless otherwise agreed upon, all images provided to the client will contain a watermark for copyright protection. Once the client selects the images to be edited, the final edited versions will be provided without a watermark.

4. Session Limitations

1. Studio and Outdoor Limits:
   We will do our best to accommodate your needs, but the number of people, pets, and props for studio or outdoor sessions may be limited due to space or weather conditions.
2. Retouching & Edits:
   All images are edited to our professional standards, but significant or excessive retouching requests may incur an additional fee.

5. Liability

1. Client Responsibility:
   Clients are responsible for the safety and well-being of their children and family members during the session. Joanna S. Photography will not be liable for any injuries or accidents during the session.
2. Weather Conditions (Outdoor Sessions):
   In the case of bad weather (for outdoor sessions), we reserve the right to reschedule the session. If we are unable to reschedule, the deposit may be forfeited.

6. Privacy & Data Protection

1. Personal Data:
   Any personal information provided during booking, such as names, addresses, and email addresses, will be kept confidential and used only for the purpose of booking and delivering services.
2. Data Protection:
   We take the privacy of your personal information seriously and follow all applicable data protection laws to ensure your information is secure.

7. Indemnification & Limitation of Liability

1. Indemnity:
   You agree to indemnify and hold harmless Joanna S. Photography and its staff from any claims, losses, or damages arising from your participation in the session or from any third-party claims relating to your use of the images.
2. Limitation of Liability:
   In the event of any failure or inability to deliver the photography services, our liability is limited to a refund of any fees paid for the session.

8. Agreement

By booking a session with Joanna S. Photography, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These terms may be updated at any time, and it is your responsibility to review them periodically.
